Terms and Conditions
Effective date: October 13, 2026
These Terms and Conditions ("Terms") govern your use of jafielden.com (the "Site"), which is owned and operated by J.A. Fielden Co., Inc. ("J.A. Fielden," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site provides general information about J.A. Fielden, our services, our market sectors, our past and current projects, and opportunities to work with us. It is provided for general information only.
2. No offer, proposal, or professional advice
Nothing on the Site is an offer, bid, proposal, quotation, or agreement to provide construction or other services. We provide services only under a written contract signed by an authorized representative of J.A. Fielden, and that contract alone sets out the scope, price, schedule, warranties, and other terms of our work.
Project descriptions, photographs, statistics, cost figures, schedules, and results described on the Site are examples of past or current work. They depend on the facts of each project and do not promise or predict the outcome of any future project. Information on the Site is not engineering, architectural, legal, financial, or other professional advice, and you should not rely on it as such.
If anything on the Site conflicts with a written contract between you and J.A. Fielden, the written contract controls.
3. Bid opportunities for subcontractors and vendors
Information on the Site about working with us is general. Registering through Prequel, joining our bid list, or contacting our preconstruction team does not guarantee that you will be prequalified, invited to bid, or awarded any work. Any work is subject to our prequalification requirements, the specific bid documents, and a signed subcontract or purchase order.
4. Careers and job applications
Job descriptions and other information about employment on the Site are provided for general information. Posting a position, receiving an application, or communicating with an applicant is not an offer of employment and does not create a contract of employment. Any offer of employment will be made in writing. J.A. Fielden is an equal opportunity employer.
When you apply, you confirm that the information you provide is true and complete. Our Privacy Policy explains how we handle applicant information.
5. Information you send us
When you send us information through the Site, such as through our contact form or job application, you agree that:
- The information is accurate, and you have the right to share it
- It does not violate anyone else's rights or any law
- It does not contain viruses or other harmful code
Please do not send confidential or proprietary information, such as project plans, pricing, or trade secrets, through the Site's general contact form. If you send us ideas, suggestions, or other unsolicited materials, we may use them without any obligation to you, unless we have agreed otherwise in writing. This does not apply to information covered by a separate written agreement with us, such as a nondisclosure agreement or bid documents.
6. Intellectual property
The Site and its content, including text, photographs, renderings, graphics, logos, and design, are owned by J.A. Fielden or used with permission, and are protected by copyright, trademark, and other laws. "J.A. Fielden" and our logo are our trademarks.
You may view the Site and print or download pages for your own personal or internal business use, as long as you keep any copyright and other notices. You may not otherwise copy, modify, republish, distribute, sell, or create derivative works from the Site or its content without our written permission.
Names, logos, and trademarks of our clients and other third parties shown on the Site belong to their respective owners. Their appearance on the Site describes our work and does not mean that those companies sponsor or endorse J.A. Fielden or the Site.
7. Acceptable use
You agree not to:
- Use the Site in a way that breaks any law or regulation
- Try to gain unauthorized access to the Site, its servers, or any related systems
- Interfere with the Site's operation or security, or bypass our spam protection
- Upload or send viruses, malware, or other harmful code
- Use robots, scrapers, or other automated tools to collect content or information from the Site, except for search engines indexing the Site for public search results
- Collect personal information about others from the Site
- Impersonate any person or company, or misrepresent your connection with any person or company
- Use the Site to send unsolicited advertising or spam
We may suspend or block access to the Site for anyone who violates these Terms.
8. Third-party links and services
The Site links to websites and services run by others, such as LinkedIn, Prequel, and Google Maps, and uses third-party services such as Google reCAPTCHA. We do not control and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms and privacy policies.
9. Disclaimer
We work to keep the Site accurate and up to date, but we do not guarantee that its content is complete, current, or error-free, or that the Site will always be available, uninterrupted, or free of viruses or other harmful components.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. This disclaimer applies only to the Site. It does not change any warranty in a written contract for our construction services.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, J.A. FIELDEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain warranty disclaimers or limits on liability, so some of the limits above may not apply to you. This section applies only to your use of the Site and does not limit liability under a written contract for our construction services.
11. Indemnification
You agree to defend, indemnify, and hold harmless J.A. Fielden and its officers, directors, employees, and agents from any claims, losses, damages, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.
12. Privacy and cookies
Our Privacy Policy and Cookie Policy explain how we collect, use, and protect information through the Site. They are part of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute arising from or related to these Terms or the Site must be brought only in the state or federal courts located in Knox County, Tennessee, and you agree to the personal jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
15. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and J.A. Fielden about your use of the Site. They do not replace or change any separate written agreement between you and J.A. Fielden.
