Privacy Policy
Effective date: October 13, 2026
J.A. Fielden Co., Inc. ("J.A. Fielden," "we," "us," or "our") is a general contractor and construction manager headquartered in Knoxville, Tennessee. This Privacy Policy explains what personal information we collect through our website, jafielden.com (the "Site"), how we use and share it, and the choices you have.
This policy covers information collected through the Site, including our contact form and online job application. It does not cover information we receive under a construction contract or project agreement, which is governed by that agreement, or information about our employees after they are hired, which is covered by our internal employment policies.
By using the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site or submit information through it.

We collect some of this information using cookies and similar technologies. Analytics cookies are used only if you allow them through our cookie banner. See our Cookie Policy for details and for how to change your choices.
Spam and security protection. Our forms use Google reCAPTCHA to protect the Site from spam and abuse. reCAPTCHA collects hardware and software information, such as device and application data, and sends it to Google for analysis. Your use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.
Information from other sources
If you apply for a job, we may receive information about you from people you list as references, from an employee who refers you, or from publicly available professional profiles you share with us. If we conduct a background check or reference check as part of hiring, we will do so only with your authorization and as permitted by law.
2. How we use your information
We use personal information to:
- Respond to you. Answer your questions, discuss potential projects, and follow up on your inquiry.
- Consider you for employment. Review your application, contact you about the position or other openings that may fit, schedule interviews, check references, and make hiring decisions.
- Work with subcontractors and vendors. Evaluate prequalification information and invite qualified firms to bid.
- Operate and improve the Site. Keep the Site running, understand how visitors use it, and make it better.
- Protect the Site and our business. Prevent spam, fraud, and misuse, and keep the Site secure.
- Meet legal obligations. Comply with employment, recordkeeping, and other laws, respond to lawful requests, and enforce our rights.
We use information about work authorization and sponsorship only to determine eligibility for employment and to comply with the law. We do not use it to make any other inferences about you.
We do not use the information collected through the Site to make decisions about you based solely on automated processing.
3. How we share your information
We do not sell your personal information, and we do not share it for cross-context behavioral (targeted) advertising.
We share personal information only as described below:
- Service providers. Companies that help us run the Site and our business, such as our website developer and host, email and IT providers, analytics providers, spam-protection providers (Google reCAPTCHA), and recruiting or human-resources tools. They may use your information only to provide services to us.
- Professional advisers. Our lawyers, accountants, insurers, and similar advisers, when needed for their work for us.
- Legal and safety reasons. Government authorities, courts, or others when we believe disclosure is required by law, regulation, subpoena, or legal process, or is needed to protect the rights, property, or safety of J.A. Fielden, our employees, our clients, or others.
- Business transfers. A buyer, successor, or other party in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business.
- With your consent. Anyone else, when you ask us to or agree that we may.
4. Cookies and analytics
We use cookies and similar technologies that are strictly necessary for the Site to work. We use analytics cookies, such as Google Analytics, only if you allow them. You can review or change your choices at any time using the Cookie Preferences link at the bottom of every page. Our Cookie Policy lists the cookies we use and explains how to control them.
Google Analytics collects information about how you use the Site and sends it to Google. To learn how Google uses this information, visit policies.google.com/technologies/partner-sites. You can also install the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout.
5. How long we keep information
We keep personal information only as long as we need it for the purposes described in this policy, or longer if the law requires it. In general:
- Contact inquiries are kept as long as needed to respond and as part of our ordinary business records.
- Job applications are kept for up to two years after the hiring decision so we can consider you for other openings, or longer if a law, legal claim, or investigation requires it. If you are hired, your application becomes part of your employment records.
- Analytics data is kept according to the retention settings of our analytics provider, which we set to 14 months.
When information is no longer needed, we delete it or make it de-identified.
6. How we protect information
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encrypted (HTTPS) connections to the Site. No website, transmission, or storage system is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information, such as Social Security or bank account numbers, through the Site or by email.
7. Your choices
- Cookies. Use the Cookie Preferences link at the bottom of any page, or your browser settings, to accept or decline non-essential cookies.
- Email. If we send you an email you do not want, reply and ask us to stop, or contact us using the details below.
- Your application. You may ask us to update your application or withdraw it from consideration at any time.
8. Your privacy rights
Depending on where you live, and subject to the laws that apply to us, you may have the right to:
- Know and access the personal information we have about you and get a copy of it
- Correct inaccurate personal information
- Delete personal information we have about you
- Opt out of the sale of personal information, targeted advertising, or certain profiling (we do not engage in these activities)
- Appeal our decision if we deny your request, where the law gives you that right
How to make a request. Email us at info@jafielden.com or call (865) 523-0508. To protect your information, we will ask you for details to confirm your identity before we act on your request, such as your name and the email address you used with us. You may use an authorized agent to make a request for you; we may ask the agent for proof that you authorized them, and we may ask you to confirm your identity directly with us.
We will respond within the time required by applicable law. We will not discriminate against you for exercising your privacy rights.
Opt-out preference signals. Because we do not sell personal information or use it for targeted advertising, there is currently nothing for a Global Privacy Control or similar browser signal to opt you out of. If that changes, we will update this policy and honor those signals as required by law.
